This website (the “Site”) is operated by Greybird & Co. (“Greybird,” “we,” “us,” “our”). We provide this Site and related products, content, tools, and services (collectively, the “Service”) to you conditioned on your acceptance of these Terms of Service (“Terms”) and any policies referenced here.

By visiting the Site and/or purchasing something from us, you engage with our Service and agree to be bound by these Terms, including any additional terms, conditions, and policies referenced herein. These Terms apply to all users of the Site, including browsers, vendors, customers, merchants, and contributors of content.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell products and services to you.

We may limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same account, payment method, and/or billing/shipping address. We may limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your information (including email address and payment details) so we can complete transactions and contact you as needed.

We may provide access to third-party tools that we do not monitor or control.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Site content without our express written permission.

SECTION 14 — SHIPPING, DELIVERY, DUTIES, AND RISK OF LOSS

Our Shipping Policy is available at https://greybird-co.com/shipping-policy and is incorporated into these Terms by reference.

Delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.

International shipments may be subject to import duties, taxes, brokerage fees, or other charges. Unless we expressly state otherwise in writing, you are responsible for these charges.

Title to and risk of loss for physical goods pass to you upon our delivery of the product to the carrier, except where prohibited by applicable law.

SECTION 15 — ALL SALES FINAL; NO RETURNS

All sales are final. We do not accept returns or exchanges.

If your order arrives damaged, defective, or incorrect, you must contact us at hi@greybird-co.com within 7 days of delivery and include your order number and clear photos of the issue and packaging. If we determine there is a qualifying issue, we may, at our option, provide a replacement, store credit, or refund.

Nothing in this section limits any rights you may have that cannot be excluded under applicable law.

SECTION 16 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error-free.

We do not warrant that results obtained from use of the Service will be accurate or reliable.

You agree we may remove the Service for indefinite periods or cancel it at any time without notice.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify, defend, and hold harmless Greybird & Co. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising from your breach of these Terms or documents incorporated by reference, your violation of any law, or your infringement of third-party rights.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed. The remaining provisions will remain valid and enforceable.

Obligations and liabilities incurred before termination will survive termination for all purposes.

These Terms remain effective unless terminated by you or us. You may terminate by notifying us you no longer wish to use our Services or by ceasing use of the Site.
